Affidavit

  • An affidavit is a declaration that is legally binding, in which a witness (also known as the affiant) swears that certain assertions are true. Affidavits are often used in court proceedings, but they can also be utilized in a wide variety of other contexts. When you are presenting a lawsuit in either provincial or federal court, you will need to have supporting evidence to back up your claims. This is where an affidavit comes in – it is a sworn or solemn statement made in writing and used as corroboration for your assertions.
  • For example: If you want to get married in another country, that nation will likely require evidence that you haven’t been married before (or that you are legitimately divorced) in order to grant you a marriage certificate. In this case, you would need to provide an affidavit of service to prove that you are a Canadian citizen and that you were legally married outside of Canada.
  • When signing an affidavit, you must remember the following points:
  1. Whatever you say in your declaration must be truthful.
  2. You should only present facts that you already know to be true.
  3. It’s okay to voice your opinion as long as you make it clear that it is, in fact, just your own opinion.
